FAQ

Frequently Asked Questions

Everything you need to know about affiliate agreements

Is this affiliate agreement template legally binding?

No. This generator produces a starter template for informational purposes only and is not legal advice. LinkJolt does not review, endorse, or guarantee the template. Have a qualified attorney review and adapt it for your jurisdiction and business before use.

What should be included in an affiliate agreement?

Common elements include: parties involved, commission structure, payment terms, cookie duration, prohibited activities (PPC bidding, spam), trademark usage, disclosure requirements, termination clauses, and liability limitations. Your lawyer can tell you which apply to you.

How do I handle disclosure requirements in my affiliate program?

Most regulators require affiliates to clearly disclose their relationship with the advertiser in promotional content. Specify disclosure language in your agreement and consult a lawyer to confirm the exact wording required in your jurisdiction.

Can I modify the generated agreement?

Yes. The output is plain text. Edit any section, add custom clauses, or remove sections that don't apply. Treat it as a starting point to hand to your lawyer, not a finished document.

How often should I update my affiliate agreement?

Review your agreement with counsel whenever you change commission structures, payment terms, or promotional guidelines, and whenever relevant regulations change.

What happens if an affiliate violates the agreement?

Your agreement should set out violation consequences: warning for minor infractions, commission forfeiture for fraud, and termination for serious breaches such as trademark infringement or false advertising. Enforceability depends on your jurisdiction.
